Unfiled Returns: Get Back to Current

Rebuild missing records, identify required returns, and address filing separately from payment.

Why Filing Matters

The IRS instructs taxpayers to file returns that are due even when full payment is not possible. Waiting can add penalties and jeopardize refunds. Refund claim time limits can apply, so do not postpone reviewing an older year because you expect a refund.

Make a Year-by-Year List

List each potentially missing federal and state return. Note whether you filed, received an acceptance, paid estimated tax, or received a notice. A missing record is a reason to verify the filing status, not to assume the agency has no return.

Rebuild the Records

Gather W-2s, 1099s, prior returns, bank records, business income and expense records, estimated-payment confirmations, and notices. Request available IRS transcripts when necessary. Transcripts can support the reconstruction but do not replace records for deductions and expenses.

Use the Right Year and Destination

Prepare the return using the forms and rules for that tax year. If the IRS sent a filing notice, use the submission destination stated in that notice. Follow California instructions separately.

Watch State Filing Demands

An FTB business Demand for Tax Return allows you to report that a return was already filed or that no filing requirement applies. Respond by the notice date with the requested evidence. Silence can lead to an estimated assessment and additional charges.

Choose the Help You Need

Straightforward missing wage returns may be manageable with appropriate preparation support. Several years, business records, substitute assessments, or uncertainty about a filing obligation justify a credentialed professional. After filing, confirm the account and review payment options.
